TERMS & CONDITIONS
Please read the following Terms and Conditions carefully before placing your order with Cakes By Rubina.
By visiting the Website or by placing an order, you will be deemed to have read and understood these terms
and conditions and agree to be bound by them in their entirety and accept that these conditions may be
modified or amended and posted on this website from time to time.
Cakes By Rubina reserves the right to refuse the sale of goods or services or to cancel an order under
certain circumstances that are beyond our control.
For your convenience we have categorized our policies into two Signature/Custom Cakes and Wedding Cakes.
Please refer to the section that applies to your order.
We bake to order only, so all the cake orders are considered as custom cakes including our signature cakes.
Payment & Deposit:
A 25 percent non-refundable deposit is required to secure any order over $300. For all other orders a full payment is required to confirm your order. Please note the order is not confirmed until the required payment is received. If the payment is made by check, please allow 3 to 5 days for check clearance. Bounced checks will incur a $20 bounced check fee which is added to the payment due.
If the deposit is paid with Credit Card, please note that we do not keep a record of your credit card so at the time of balance due, we will contact you to provide the credit card again to charge the balance amount. You can also opt to pay the full amount at the time of placing the order, instead of paying just the deposit.
If placing an order within last two week period, then full payment is due in order to proceed with the order.
The balance must be paid and received TWO WEEKS prior to delivery or pickup. Orders will not be delivered or completed unless the payment is made in full. If the balance payment is not received by the due date Cakes By Rubina reserves the rights to cancel the order and the deposit will be forfeited. If the balance is received after the order has been marked as cancelled then Cakes By Rubina will not guarantee the cake to be ready by the due date.
Last Minute/Rush Orders:
All orders placed within last 72 Hours must be paid in full. Due to tedious, handcrafted nature of our products, we are unable to cancel or make any changes to such orders.
Changes And Alterations...
Changes in Decorations:
If you have a need to make any changes to an order please contact us immediately. We will assess your request and let you know its effect on the price and any agreed timeline. It is at the discretion of the Cakes By Rubina to accept such requests. Due to our attention to detail, we spend many hours planning and preparing before even beginning on a cake and there are certain decorations like sugar flowers and figurines that are made well in advance, usually 5 to 7 days to give enough time for such decoration to get set.
Most of the fondant decorations, 3D figurines and fondant cake toppers are all part of major changes. There is lot of effort and time consumed in finalizing the cake design. Once the design is finalized and the deposit paid there will be no major change in design. At this you may cancel the order and start over again. Please refer to our cancellation policy if you decide to cancel and restart.
We may be able to honor certain decorative changes if they are made 7 days prior to delivery/pick up date.
Changes in Cake Flavor and Filling/Frosting:
Occasionally but not always we may be able to accommodate some of these changes if conveyed 2 weeks before the cake due date with additional charges. The extra charges must be paid to confirm the change. No changes are going to be entertained in two weeks before the cake due date.
Change in size and/or number of servings:
Once the order is confirmed we will not be able to reduce the size or number of servings as we have already allocated the time and resources for this cake that we would have used for some other order. For the increase of size, we highly recommend to add another cake to make up for the servings. Some of our signature cakes can be made available in different sizes within a short notice of 48 to 72 hours.
Please know that we will not be able to honor any change in size or number of servings within two weeks before delivery/pickup as we have already allocated resources and time to this order. All changes must be confirmed with a staff member of Cakes By Rubina.
Change in delivery/pickup date:
Please refer to the section "Change Of Venue/Date" for details.
Cancellation And Refunds....
All refunds are issued only as store credit (no cash/money refunds will be given).
Our refund policies for all custom (non-wedding) cakes are as follows:
• No refund is issued if the order is cancelled within 3 days (72 hours) before delivery/pickup.
• 25% of the total amount will be refunded if the order is cancelled within 7 to 3 days before delivery/pickup date.
• 50% of the total amount will be refunded if the order is cancelled within 14 to 7 days before delivery/pickup date.
• Total amount minus the deposit (25%) will be refunded if the order is cancelled before 2 weeks prior to deliver/pickup date.
Orders that are not picked up will not be refunded. Cake By Rubina will not be responsible for any cakes that are not picked up on time.
Change Of Venue/Date.....
We understand sometimes plans can change and we will try our best to assist you in making changes to your order data/time. Any such changes may incur 25% of the total amount as additional charges. Such changes must be made at least 3 weeks prior to scheduled date/time. We will not be able to accommodate changes made in the last three weeks prior to delivery/pickup date/time and no refund will be issued.
If the venue/date is postponed because of health reasons we will try our best to allocate new date/time with no additional cost but you must let us know at least a week in advance.
At Cakes By Rubina we pride ourselves on the quality of our products and services.
All our ingredients are of the highest quality. Cake flavor and texture is subjective. Most people love our quality cakes, but it's impossible to predict everyone's particular taste preferences. If we have made a genuine mistake, (like wrong flavor then the agreed upon specs), we will try our best to make it right. It is our goal to keep our clients happy and satisfied.
You may qualify for partial refund in the form of store credit if the cake is brought back to us within 24 hours of deliver/pickup and the quality of cake flavor or texture is determined to not meet our standards. Partial refund will also depend on the amount of cake already consumed. There will be no refund if cake has been consumed or has not been brought back to our store.
If you come to our store for pick up or if upon delivery the cake does not meet the agreeable specs and expectations, we will give you a refund (minus 25% handling/cancellation fee) in the form of store credit.
NOTE: If we give you a refund, you CANNOT keep the cake. You can only get the refund if you refuse to “accept” the cake. We are not responsible for any expense you may incur for replacing our cake.
Cakes are very fragile and require care and attention when handling, storing, and displaying. Damages to a cake can happen if not handled properly – such as cracks, smudges, melted frosting, etc. On collection/pickup of the cake, risk passes to the client the moment the cake has been handed over and left our facility. No responsibility whatsoever will be taken by us for any damages or deterioration of the cake due to transportation and storage. Please note that cakes are very fragile and break easily. Drive carefully and slowly.
For all sculpted and other customized cakes that are delivered to a venue, it is the responsibility of the client (or a person in charge) to inspect the cake and report to the delivery person of any damages. After that point Cakes By Rubina will not be responsible for any damages to the cake. In case of any damage every effort will be made to restore the cake but if the damages are beyond repair then refund will be issued according to our refund policy. Cakes By Rubina will not be held responsible if the damages are reported after the delivery/receiving of the cake.
If a mistake has been made that does not adhere to the order specifications signed by you, we are only liable to the amount of the cost of the specific cake. No losses beyond this point.
Cakes By Rubina will make every effort to deliver the cake on time at the venue. If for any reason the cake is not delivered within two hours of the designated time, a full refund will be issued. Cakes By Rubina will not be responsible for any additional expenses that you may incur as a result of our failure to deliver the cake. Our liability is limited to the contracted value of the cake.
Payment & Deposit.....
Non Refundable 25% of the total amount. Order will not be confirmed until the deposit is paid and received by Cakes By Rubina.
Balance is due week before due date. If the balance is not received by the said date, Cakes By Rubina reserves the right to cancel the order or charge additional fee not more than 10% of the total amount. If the balance is delayed by more than a week then order will be cancelled.
Changes And Alterations.....
Change in Design:
NO CHANGES are allowed after the contract has been signed.
Change in Size:
Once the contract is signed you cannot reduce the cake size or number of servings as we have already allocated time and resources for your cake that otherwise could be used for other orders. However you may request for an increase in size or servings and we will try our best to accommodate either increasing the size or providing an additional separate cake to fulfill the number of servings at an additional cost.
Change in Date:
We fully understand that sometimes the plans can change.
If the change in the date is because of any unforeseen circumstances like the health/hospitalization of bride/groom/immediate family or other natural disaster that are beyond control, we will try our best to accommodate for any future date based on our availability for new date. If such change is brought to our notice prior to three weeks before due date and we are able to provide the same service for the future date then all the deposit and the balance will be transferred to the new due date. If for any reason we are unable to accommodate for the new date we will refund the total amount minus the deposit.
If the change in date is for any other reason and is brought to our attention three weeks prior to due date, again we will try our best to accommodate for any future date with additional charges of 20% of the total amount. If the change in date is brought to our attention within three weeks of the due date then Cakes By Rubina reserves the rights to cancel the order and full amount will be forfeited.
Cancellation And Refunds.....
All refunds are issued only as store credit (no cash/money refunds will be given).
If the cancellation is because of sickness (of either bride or groom) or some natural disaster and is brought to our attention a week or more before the due date then 25% deposit will be forfeited and the remaining amount will be refunded according to our refund policy. If any such incidence (sickness or natural disaster) happen within one week prior to due date then there will be NO REFUND.
If the cancellation is for any other reason, than the refund policy will be as under
• Before four weeks prior to due date the deposit will be forfeited
• Between four and two weeks prior to due date we will refund 50% of the total amount. If the balance was not paid yet than the remaining
amount is due (to make it 50% of the total amount) within one week to confirm cancellation.
• Two weeks and under prior to due date then there will be no refund. Total amount will be forfeited.
Cancellation by Cakes By Rubina.....
If the order is cancelled by Cakes By Rubina because of sickness, store closing or some natural disaster that are beyond our control then a full refund will be issued. Cakes By Rubina will not be responsible for any additional expenses that you may incur as a result of our failure to deliver the cake. Our liability is limited to the contracted value of the cake.
Most of our cakes with buttercream filling and frosting can stay inside the cooler for 5 to 7 days. Other cakes with fresh fruit, fresh cream and cream cheese need to be consumed within 24 to 48 hours as we do not use any preservatives. We highly recommend to pickup all such cake on the due date and to enjoy them as they are fresh. We do not guarantee the freshness of cakes with fresh fruit, cream cheese and fresh cream (including cheese cakes) if they are not picked up on time.
The customer will be reminded once only either by email or phone (if provided), If the cake is not picked up by third day of the due date the cake will be disposed of without any notice.
Any individual picking up a cake must arrive on or before the agreed upon time. Please know that Cakes by Rubina has the right to leave if the agreed upon time is not honored by the customer.
If you choose to pick up your cake and transport it yourself, we are not responsible for the cake once it has left the bakery. We are not liable for any damage occurring to the cake during transport, set-up or any time subsequently. You will be given instructions on how to carry, transport, and store your cake upon pick up. We do everything in our power to provide a well-structured cake, but please note that cakes are very fragile and prone to cracks, smudges etc. Drive carefully and slowly.
Orders that are not picked up will NOT be refunded. Because of the nature of our business and our quality assurance, we will dispose of the product that is not picked up within 2-3 days after the due time.
A cake table that is all set up (skirted & covered) must be available at delivery time. It must be secure, level and be able to support a minimum of 50 pounds. Please have a trusted individual present at the time of delivery to accept the delivery. Once the cake is set up and accepted, it is no longer the responsibility of Cakes by Rubina and we will not be held responsible.
The client assumes full responsibility arranging for the caterer/servers to cut, serve and remove all existing supports inside of the cake. All cake supports used are made of non-toxic products. We will not be liable for any injuries that may occur due to failure to remove the necessary supports.
Orders that require delivery and cannot be delivered due to customer’s wrong information or availability will be brought back and stored for 2-3 days. Should you require a future delivery date, you will be held responsible for an additional delivery charge. Because of the nature of our business and our quality assurance, we will dispose of the product in 2-3 days if no re-delivery/pickup date has been conveyed and you will NOT be refunded.
Placement of Fresh Flowers upon Delivery.....
It is important that upon delivery of the cake your florist has the flowers ready for us to be placed on the cake and that they are the correct type and number needed to complete your desired design. Please know that if flowers are not present at the time we arrive, we may be unable to wait for more than 10-15 minutes due to our often delivery schedule of other cakes &products. If we must leave without the flowers being added to your cake, it will be your or your wedding coordinator’s responsibility to decorate the cake with the flowers upon our departure. We are not responsible for damages that occur if other parties attempt to place flowers on the cake.
Weather / Climate Conditions.....
A variety in temperature and humidity can impact the flavor, the texture of the cake as well as the decorations. High temperatures, direct sunlight, and an extended period without refrigeration at the location can have adverse effect on the cake. We take every step possible to ensure best quality product upon delivery. However we cannot be held responsible for unfavorable conditions at the cake’s destination. It is your responsibility to ensure that the cake will be stored and set-up in an area that is climate controlled to ensure that the cake remains intact and retains its original condition.
Cakes are extremely fragile and can damage easily if slightly mishandled. We can provide some basic guidelines on how to transport a cake but do not guarantee of any sort because we do not know the driving conditions or how the cake was handled when it let our store/premises.
Here are some basic guide lines:
• The cake needs to sit on a flat surface either in the trunk or on the floor in front of the front seat.
• We do not recommend holding the cake in the lap.
• We do not recommend putting the cake on a seat as the seats are generally inclined.
• If the cake is small we would recommend to use a cooler that it can fit in.
• If the cake is large we would recommend to turn the AC to Max as cold cakes generally hold well during transportation.
• Make sure nothing should fall on the cake.
• Drive slowly and steadily and avoid any sudden brakes.
Cake Care and Storage.....
We can only provide some basic guidelines but do not guarantee as we do not know how the cake was stored and handled.
You can store the buttercream cakes for a 5-6 days in a refrigerator. To consume the cake it must be brought to room temperature by leaving it at room temperature for at least three hours. The buttercream cakes can stay outside for four to five hours easi. If there is fresh fruit please adjust the time accordingly as you cannot leave the fresh fruit for that long.
We are sorry we cannot guarantee that any of our products are 100% free of allergens. Please note that although a product may not contain allergens as an ingredient, however it come in contact with utensils and equipment that contain these contaminates. It would be best to inform your guests that it is their choice to consume our product, and we will not be liable for any allergic reactions. All of our products are prepared on shared equipment.
We make every attempt to ensure that our baked goods are free from foreign objects. We are not responsible for damages caused by foreign objects such as candles, sparklers or other decorations that are placed on or in our products, nor are we responsible for damages to said products, or persons handling them once they are picked up, removed, or delivered from our premises.

Please know all our products are hand crafted so when you provide us an inspirational design image we cannot make an exact duplication. It would be subjected to our own artistic interpretation.
Cakes by Rubina has the right to post photographs/ images of any of our work on our website, social media sites, in our bakery or at event venues (with the exception of images showing the faces of customers without their prior permission).
Cakes by Rubina reserves the right to terminate any agreement/order any time if becomes insolvent, bankrupt, or enters receivership, dissolution, liquidation, or termination for Change of Control. We may terminate this agreement with immediate effect, by giving 14 days notice to the customer. Only in this case all deposits will be refunded.
